Background to Development:
Various Laws prohibit land owners from subdividing
land or from developing land for non agricultural purposes.
Some of these Laws are;
- Act 70/1970 – The Subdivision of Agricultural
Land Act.
- The National Roads Act (KZN).
- The Provincial Roads Act (KZN).
- The Planning and Development Act (KZN).
Greene Land is familiar with the provisions
of all these Acts and has made numerous applications
in terms of these Acts to obtain consent for developments.
In addition Greene Land has made in
excess of 50 applications in terms of the Development
Facilitation Act which empowers the Tribunal
established in terms of the Act to set aside the provisions
of these Acts.
Depending on the size and scope and location of the
development various other issues may come into play,
some of these are:
- Geotechnical Conditions
- Environmental Impact
- 100 year Floodlines
- Traffic Impact
- Provision of Services such as water, electricity,
sewerage and stormwater.
